Terms of Service

Welcome to "Two". These Terms of Service ("Terms") govern your access to and use of the "Two" messaging application and website twomessenger.com, operated by Coptersolutions, based in Andorra.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Description of Service

"Two" is a private messaging application designed for private communication between two individuals. We provide end-to-end encrypted messaging, media sharing, and relationship features.

2. Eligibility

You must be at least 16 years old to use "Two". By using the Service, you represent and warrant that you meet this age requirement.

3. User Account

• Security: You are responsible for maintaining the confidentiality of your login credentials and encryption keys. Coptersolutions cannot recover your messages if you lose your device or keys.
• Accuracy: You agree to provide accurate information during registration.
• Responsibility: You are fully responsible for all activities that occur under your account.

4. User Conduct

You agree NOT to use "Two" to:

• Violate any laws or regulations of Andorra or your local jurisdiction.
• Infringe upon the intellectual property or privacy rights of others.
• Distribute malware, viruses, or harmful code.
• Harass, abuse, or harm another person.
• Prohibited Technical Acts: Attempt to reverse engineer, scrape, automatically gather data, or tamper with the app's security features.

5. User Responsibility for Security & Content

You acknowledge that "Two" provides tools for privacy (e.g., Disappearing Messages), but it is your sole responsibility to use them correctly.

• Screenshot Liability: While "Two" employs OS-level technology to block screenshots of disappearing media, we cannot prevent all methods of capture (e.g., using a secondary camera). Coptersolutions specifically disclaims any liability for unauthorized capture or distribution of your content by your recipient.
• Settings Usage: You are responsible for ensuring your "Ghost Mode" (disappearing timer) is active when sending sensitive content. Content sent without this mode enabled behaves like a standard permanent message.
• User Content: You are solely responsible for the content (text, media, audio) you create, transmit, or display. Coptersolutions acts as a passive conduit for your encrypted communication and does not actively monitor, censor, or control user content. We assume no liability for the legality, accuracy, or appropriateness of content sent by you or your partner.

6. Termination and Discontinuation

• Termination by Us: We reserve the right to suspend or terminate your account at our sole discretion, at any time, for any reason, including but not limited to a violation of these Terms.
• Discontinuation of Service: We reserve the right to modify, suspend, or discontinue the "Two" service (in whole or in part) at any time, with or without notice to you.
• No Liability for Purchases: In the event of account termination or service discontinuation, you acknowledge that you are not entitled to any refund or compensation for any In-App Purchases, subscriptions, or digital goods previously acquired. Usage of paid features is contingent upon the availability of the Service.

7. Indemnification

You agree to defend, indemnify, and hold harmless Coptersolutions, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

This defense and indemnification obligation will survive these Terms and your use of the Service.

8. Intellectual Property

All rights, title, and interest in "Two" (excluding user-generated content) are and will remain the exclusive property of Coptersolutions. The logic, design, and branding are protected by copyright and intellectual property laws.

9. Disclaimers

• "As Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, regarding reliability, availability, or fitness for a particular purpose.
• Data Storage: Encrypted messages and media are stored on our servers to ensure availability across your devices. They are persistent until they are automatically pruned by your customized rolling message limit (1-50 messages) or you explicitly delete them. You are responsible for managing your own data retention.
• No Emergency Services: "Two" is not a replacement for your primary telephone service and cannot be used to contact emergency services (e.g., 112, 911). You agree to use your mobile phone's native dialer for emergency calls.

10. Limitation of Liability

To the maximum extent permitted by Andorran law, Coptersolutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of your use of the Service or the discontinuation thereof.

Monetary Cap: In no event shall Coptersolutions's aggregate liability for all claims relating to the Service exceed the greater of one hundred euros (€100) or the amount you paid Coptersolutions, if any, in the last 12 months.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Principality of Andorra, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Andorra.

12. Global Use & Export Compliance

You are responsible for complying with all local laws and regulations regarding online conduct and acceptable content. You represent and warrant that (i) you are not located in a country that is subject to a U.S. or EU government embargo, or that has been designated as a "terrorist supporting" country; and (ii) you are not listed on any government list of prohibited or restricted parties. If you use the Service from outside Andorra, you are solely responsible for compliance with all applicable local laws, including but not limited to encryption export/import regulations.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

14. Subscriptions and Auto-Renewal

"Two" offers Premium auto-renewable subscriptions (Monthly and Yearly). By purchasing a subscription, you agree to the following terms:

• Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.
• Auto-Renewal: Your subscription automatically renews unless cancelled at least 24 hours before the end of the current period.
• Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
• Managing Subscriptions: You can manage and cancel your subscriptions by going to your App Store Account Settings after purchase. Coptersolutions does not directly process or manage your subscription payments; all billing is handled entirely by Apple.
• Cancellations: If you cancel your subscription, you will continue to have access to Premium features until the end of your currently paid billing period.
